What are Mineral Rights? How do I know if a property I am interested in buying has Mineral Rights?

Mineral rights are the ownership of the minerals (i.e., phosphate, oil or natural gas) located below the surface of a piece of land. In Florida, including parts of Manatee County, there are lands where the Mineral Rights are owned separate to the land surface rights. If you want to confirm that a property has its Mineral Rights, then we recommend that you hire a real estate attorney or title company with knowledge in Mineral Rights to conduct a title or deed search. Purchasing land without the Mineral Rights may restrict land use and building opportunities as Mineral Rights usually allow the extraction of the minerals regardless of any surface improvements or structures.
